The study of Fiqh helps fulfil this obligation such that one can live their life in line with the intent of the Lawgiver. The science is also known as Fiqh Al-Asghar (the lesser fiqh) and ‘Ilm Al-Furu’ (knowledge of the branches).
Linguistically referring to ‘understanding’, Fiqh technically refers to the study of sacred rulings pertaining to actions of the accountable which are extracted from the detailed evidence (primarily the Quran and Sunnah, as well as ijma’ and qiyas). In terms of priorities, the jurists begin with worship, then commercial law, family law and lastly the judiciary. Classically, students study Fiqh in adherence to a school of thought (madhab) whose texts cater to beginners, intermediate students and inter-madhab comparative encyclopedias.
This course seeks to cover a beginning primer in the Hanbali Madhab, one of the four Sunni jurisprudential schools of thought. From amongst the beginner primers in the school of Imam Ahmad, Bidayatul Abid (Wa Kifayatul Zahid) is a popular first text for latter-day Hanbali students. As its name suggests, the book covers the section on worship only which therefore commences the worshipper and suffices the ascetic. Written by Imam Abdul-Rahman Al-Ba’li, the concise manual covers the relied upon Hanbali positions across the books of purification, ritual prayer, funeral rites, Zakat, Fasting, Hajj and Jihad. From amongst the commentaries of this book is Bulugh Al-Qaasid which was also written by Imam Ba’li. Once a student has mastered this text (or an equivalent primer in another school of thought), they can then gradually move onto learning more detailed explanations, the reconciliation of conflicting evidence and the debates between jurists.
